The surcharge has been privately applied. I think it is a fantasy piece. As such it is quite interesting.

Is it legal for a company to buy a bunch of stamps and they "adjust" them to their own uses? I know of cases where private perfs have been added to imperforate stamps or rouletted ones. I know of cases where stamps have been bisected or trisected and used for private mail service, trake Canada'a Port Hood provisionals. Some of this does happen, but are they legal since the Post Office is a government agency?

I do not think this was made by a company. It was likely made by a philatelist who was just having fun. I suspect that as long as nobody tries to get more value out of the stamp than it is worth, the US POD would not really care.

That is a broad question.

The post office regulation states that mutilated or defaced stamps are not valid for postage. The stamp illustrated earlier in this thread would be considered to be defaced.

Other than that, anyone can mutilate/deface any stamp that they want for their own purposes, outside of trying to use the stamp for postage.
